Jean F. Gerbini

Of Counsel

An attorney with Whiteman Osterman & Hanna since 1986, Jean Gerbini focuses her practice upon issues affecting consumers and providers of insurance. She has represented policyholders in complex, multi-party insurance coverage actions in federal and state courts. She advises companies, municipalities and public authorities on insurance and indemnity aspects of corporate and commercial transactions, including mergers and acquisitions, and contracts involving construction, supply, distribution and licensing. Additionally, she provides advice and advocacy in connection with group self-insurance, licensure of insurance agents and brokers, and domestic and international commercial transactions. Trained as a mediator, she also serves as a neutral to assist in the negotiated resolution of disputes.

Representative Accomplishments
  • Represented policyholders in complex insurance coverage litigation before New York's highest court and before the U.S. Court of Appeals.
  • Negotiated settlements in complex, multi-party insurance coverage disputes in judicial and non-judicial settings.
  • Counseled group self-insurance organizations with respect to organizing subsidiaries, partnering with similar entities in- and out-of-state, meeting Workers' Compensation Law guidelines.
  • Set up organizations providing services to the insurance industry.
  • Drafted agreements in connection with importing, exporting, international licensing, agency and distribution agreements (United States, Europe, Middle East, China), establishment of domestic and international business enterprises.

  • Spoke on risk management and insurance issues at the 1996 Central Ontario Business and Industrial Show on Expanding Your Business Into the United States.
  • Presented a paper on “Allocation of Coverage Liability for Continuing Environmental Injuries,” at the 1996 Insurance Information Counsel Meeting, Chicago, Illinois.

Affiliations

Ms. Gerbini is an active participant in the activities of the New York State Bar Association ("NYSBA"), where she serves on the House of Delegates, is incoming Chair (2017) of the Sections Caucus and serves on the Executive Commtitee of the Torts, insurance and Compensation Law Section.  She is President (2017) of the Capital Roots, Inc., formerly known as Capital District Community Gardens.  

Background/Education

Ms. Gerbini received her A.B. degree from Harvard University in East Asian Studies (magna cum laude, Phi Beta Kappa), and her J.D. degree from Albany Law School of Union University (co-chair, International Law Society). She has studied Mandarin Chinese, French and Arabic and lived in India, Taiwan and China.
